Balogun said: “He is having a health challenge and from our discussion yesterday, he was supposed to come to court this morning, but his currently in the hospital."

He also said the Fani-Kayode’s doctor has advised he stayed back.

Also providing a medical report to the court, Balogun, apologized for his client’s absence.

“May Lord, it is on this note that we pray your lordship to adjourn the matter,” Balogun said.

Confirming the Fani-Kayode’s health condition, Ojogbane said, the defence counsel had shown him a letter from the hospital.

He said the application for an adjournment on the ground of ill-health by the defendant will not be objected to.

“Being the first of its kind on this matter, my lord, we will not be objecting to it,” Ojogbane said.

At the defendant’s prayer and statement by the prosecution on objection, Justice Tsoho, adjourned the matter to Monday, February 6.
